Terms of Service

These Terms of Service ("Terms") govern your use of the ZimChat mobile application, operated by BFSENTAIN Technologies (Pvt) Ltd ("BFSENTAIN", "we", "us"). By creating an account or using ZimChat, you agree to these Terms.
1. Eligibility
You must be at least 16 years old to use ZimChat. By using the app, you confirm that you meet this requirement and that all information you provide is accurate.
2. Your Account
- You are responsible for maintaining the security of your device and account.
- Accounts are verified using a one-time password (OTP) sent to your phone number. You must not share your OTP or account access with others.
- We reserve the right to suspend or terminate accounts that violate these Terms or Zimbabwean law.
3. Trust Gate — Verified Features
Certain features — including Pro subscriptions, administrative tools, mobile money functions, and elevated messaging or calling limits — require identity verification. Unverified accounts will not have access to these features. This policy exists to protect users and comply with applicable financial and data protection regulations.
4. Acceptable Use
You agree not to use ZimChat to:
- Send unlawful, threatening, abusive, or fraudulent content.
- Harass, impersonate, or harm other users.
- Distribute malware, spam, or unauthorized advertising.
- Attempt to bypass, reverse-engineer, or interfere with ZimChat's security systems, including encryption or verification systems.
- Use the platform for any activity prohibited under Zimbabwean law.
5. Encrypted Messaging
Personal messages sent through ZimChat are protected with end-to-end encryption using the Signal Protocol. BFSENTAIN Technologies cannot read the content of encrypted personal chats and cannot recover message content if a device is lost. You are responsible for keeping your device secure and backed up as appropriate.
6. Payments and Subscriptions
Where paid features (such as Pro subscriptions) are available, payments are processed through the applicable app store's billing system or an approved payment partner. Prices, features, and billing terms will be clearly displayed before purchase. Mobile money features (such as EcoCash) will only be enabled once BFSENTAIN Technologies holds the required regulatory licensing.
7. Content Ownership
You retain ownership of the content you send through ZimChat. By using the app, you grant BFSENTAIN Technologies the limited technical permissions necessary to transmit, store, and deliver that content as part of operating the service.
8. Service Availability
ZimChat is provided on an "as is" and "as available" basis. As a beta product, some features may be incomplete, temporarily unavailable, or changed without prior notice. We do not guarantee uninterrupted or error-free service.
9. Limitation of Liability
To the maximum extent permitted under Zimbabwean law, BFSENTAIN Technologies (Pvt) Ltd shall not be liable for indirect, incidental, or consequential damages arising from your use of ZimChat. Nothing in these Terms limits liability that cannot be excluded under applicable law.
10. Changes to These Terms
We may update these Terms as ZimChat develops. Continued use of the app after changes are posted constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of Zimbabwe. Any disputes will be subject to the jurisdiction of the courts of Zimbabwe.
